More than one entity may operate a pharmacy at any given location
In its judgment of 16 September 2016 (ref. no.: VI SA/Wa 288/16), the Voivodship Administrative Court in Warsaw decided that the fact that on the day of the submission of an application for obtaining a permit to operate a pharmacy at a given location there is another pharmacy operated at such location does not constitute any obstacle to considering such application. The fact that there exists a permit to operate a pharmacy at a given location does not exclude the possibility of granting another permit to operate a pharmacy on the same premises to another entity. Pharmaceutical law does not stipulate that from the time of the submission of the application for obtaining such permit for a given location another activity cannot be carried out at such location, including the operation of another pharmacy.
