New obligations for businesses introducing beverages, including liquid food supplements on the market
On 31 January, the Government Legislation Centre website published a project of an Act amending the Act on packaging and packaging waste management.
In addition to the obligation to ensure selective collection of packaging waste, the draft provides for an obligation to introduce a deposit system to support selective waste collection. The deposit system would cover:
1) single-use plastic bottles with a capacity of up to 3 l, including their caps and lids made of plastic, with the proviso that this does not apply to glass or metal beverage bottles and beverage bottles intended for food for special medical purposes,
2) reusable glass bottles of a capacity of up to 1.5 litres.
The draft defines beverages as liquids intended for consumption, in particular such as juices, nectars, milk, yoghurt and other drinkable dairy products and alcoholic beverages. The definition of a beverage is not a closed list, so the planned modification will also apply to dietary supplements in liquid form as liquids intended for consumption.
The project results from the obligation to implement Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the environmental impact of certain plastic products.
