Important judgment on official prices
The European Court of Justice decided that the situation when a Member State sets uniform prices of prescription only medicines is contrary to EU law as it restricts the free movement of goods and competition.
More than one entity may operate a pharmacy at any given location
In its judgment of 16 September 2016 (ref. no.: VI SA/Wa 288/16), the Voivodship Administrative Court in Warsaw decided that the fact that on the day of the submission of an application for obtaining a permit to operate a pharmacy at a given location there is another pharmacy operated at such location does not constitute any obstacle to considering such application.
According to Rzeczpospolita, the Ministry of Health plans to introduce a number of changes to the Pharmaceutical Law. The scheduled amendments include:
- withdrawal of cosmetics from pharmacies;
- introduction of the so-called drug issue charge (a fixed charge received by pharmacies for issuing drugs to patients which is to be paid by patients themselves; seniors, children, pregnant women and people with disabilities would be exempt from this obligation);
